Eligibility, Registration and Account Security

Abusive Activities

You acknowledge and agree that you may not use our servers and your website as a source, intermediary, reply to address, or destination address for mail bombs, Internet packet flooding, packet corruption, denial of service, or other abusive activities. Server hacking or other perpetration of security breaches is prohibited and we reserve the right to remove sites containing information about hacking or links to such information.

Storage and Security

You shall be solely responsible for undertaking measures to (1) prevent any loss or damage to your website or server content; (2) maintain independent archival and backup copies of your website or server content; and (3) ensure the security, confidentiality and integrity of all your website or server content transmitted through or stored on our servers. You agree to take full responsibility for all files and data transferred and to maintain all appropriate backup of files and data stored on servers purchased through or from us. Our offered servers are not an archive and we shall have no liability to you or any other person for loss, damage or destruction of any of your content. None of our offered Servers or Services are intended to provide a PCI (Payment Card Industry) or HIPAA (Health Insurance Portability and Accountability Act) compliant environment and therefore should not be used or considered as one.

You shall at all times remain data controller of any such personal data without any liability of whatsoever nature to us. You will not provide us any personal information with respect to Your clients, visitors, end-users. You acknowledge that We may in certain limited cases have access to information and communications systems for the purposes of web designing, hosting setup, deployments, integrations, development, installation & update either as per the task allotted by you as client or tasks which are performed for as IT operations for clients. Website/Server Content

You shall be solely responsible for providing, updating, uploading and maintaining your website or server and any and all files, pages, data, works, information and/or materials on, within, displayed, linked or transmitted to, from or through your website or server including, but not limited to, trade or service marks, images, photographs, illustrations, graphics, audio clips, video clips, email or other messages, meta tags, domain names, software and text. You acknowledge and agree that in the course of providing you with technical assistance, it may be necessary for our support staff to modify, alter or remove the content of your hosted product. Your website or server content shall also include any registered domain names provided by you or registered on behalf of you in connection with the Services.

Resource Usage

a. Customers are required to utilize server resources in an efficient and responsible manner. Excessive use of server CPU and memory resources by a customer can interfere with or prevent normal service performance for other customers. Bulk Mailing, Using Malware or Suspicious Script and any such activity is not supported by us and we do not take any responsibility for the damage or downtime caused by any such activity.

b. Customers are requested not to use any of our offered services/servers/servers space/rented space or any other product for hosting/storing/saving monetary data or data related to financial transactions or services related to cryptocurrency mining or exchange or services related to wallets or any other equivalent format of currency whether digital/crypto/fiat currency. We do not offer support or offer services for hosting digital or financial currency transactions or data. In cases if any customer has hosted or used our services for hosting such data is strictly his/her own responsibility in all manner. We consider it absolutely against our policy to use our offered services for any such above mentioned purpose.

c. We cannot and do not monitor each and every website or asset hosted on server space offered by us whether direct or whether by third party vendors. It is completely customers/users responsibility to ensure that he/she/it uses offered services for genuine business purposes only which should be completely legal and acceptable by Indian or any legal constitution. We do not support or wish to engage with any tenant or reseller who is engaged in fraudulent/scam/spam business or equivalent. We only wish to participate in completely ethical and legal business by offering hosting services to individuals and businesses, support business communication, support IT business operations through our services.

Choices for Personal Information

When you sign up for a particular service that requires registration, we ask you to provide personal information. If we use this information in a manner different than the purpose defined herein and in the terms of the services offered then we will ask for your consent prior to such use. Any website deletion or data loss or loss of domain or hosting or any such losses arrising out of failure in purchased service renewal or due to delay in payment is not responsibilty of serverscart.com or any of its officers, members.

Limitation of Liability

The Service is provided on an “as is” and “as available” basis and the use of the Service is at your own risk. Refunds & Returns

PAAS uses automated pre-integrated API calls for booking products including those booked internally as well as with vendors and third parties; is out of our manual control.
Product once sold cannot be refunded
Product once purchased cannot be returned
Product once ordered and paid for cannot be cancelled
Product is not a physical product hence requires no shipping

Legal Declarations

Paying of the invoice or use of any of our products/services is assumed as your acceptance of terms of service mentioned on the Terms & Conditions. We do not monitor the purpose of use of the data hosted on any of servers or rented hosting space by the tenants. We strictly do not support, encourage, or participate in any actions/business not permitted by Indian laws or considered fradulent or illegal in any manner in India as per Indian Laws. Any hosted data not acceptable by Indian Constitution & Jurisdiction is equally not acceptable by us.
